SERVICE POLICIES

  • All images remain copyrighted property of Middle Earth Media.

    • By purchasing and/or downloading images as the client you agree to use for personal use only and agree you are not legally allowed to sell or monetize images with/to any third parties.

    • If images are ordered/downloaded for business purposes you as the client agree the images remain property of Middle Earth Media and may be used for promotional purposes by us. You also agree you have the license to use for business promotional and non promotional purposes but can not monetize or sell images to any third parties.

    • By ordering and/or downloading images you agree to not edit or change the images in any way unless written consent is given by Middle Earth Media. For business purposes however, editing such as social media filters and stickers are permitted within reason. Business info or wording may be overlaid on or around images ordered under our business category.

  • We urge you as the client to consult with us and order carefully to make sure it is a fit for you, as we do not offer refunds. This is because of the nature of this service as all orders require planning, admin and time that can often be before the actual product is delivered. For these reasons if you would like to cancel your order you will be charged for anything we have already started working on. This includes but not limited to any planning, social media plans, website designs, photography shoots, editing, design, venue bookings, information and consultations. Any remaining amount paid can be credited towards any of our services.

    • Any images that are downloaded or have already been received physically or electronically by the client (and passed the 3 day grace period mentioned in section: Customer Satisfaction) are considered delivered/finished and can not be refunded.

    • To reschedule a booking you must advise us at least 48hrs before the time of your appointment. If you do not advise us, it will incur an extra fee on your next booking.

    • For any projects where you have received a proposal or quote and the work is ongoing, either party has the right to give notice of termination to the proposal. Once the proposal is accepted, if Middle-Earth Media (or any of their contractors) have felt communication has not been sufficient to engage and fulfill the client’s project, they can terminate the project effective immediately and the project will be billed at the price stated on the proposal/invoice.

    • Four weeks’ notice in writing must be given from the clients on any proposal they wish to terminate; any projects started, and any outstanding bills will be paid in full by the client.

    • In light of recent worldwide events some projects might be taken on a case by case basis and refund could be discussed if no work has started.

  • All bookings must be made, confirmed and secured by full payment by online store purchase, the date on your invoice or at least 7 days prior to set date.

    For events or other contracts please contact us for specific guidelines and payment options & time-frames.

    For any unpaid invoices you have 3 business days to make payment from the due date marked on the invoice unless otherwise stated in correspondence. After the 3 day grace period you will be charged a fee of $35 per day until payment is completed.

  • If you are not completely satisfied with the delivered images, we are more than happy to review and re-shoot or re-edit based on your preference. We are a creativity-based company and often miscommunication of a concept or idea can be misinterpreted and created differently to what you as the client had visualized. We know this can sometimes take some tries to get to where you are happy and satisfied and are more than happy to work with you to get there.

    1. For any changes you need to get in touch with us within 3 business days from the delivery of images/products. After 3 day mark you will have to make a new order/booking. Any rework is done within reason and is all subject to our discretion and capabilities.

    2. For any projects where you have received a proposal or quote and the work is ongoing, either party has the right to give notice of termination to the proposal. Once the proposal is accepted, if Middle-Earth Media (or any of their contractors) have felt communication has not been sufficient to engage and fulfill the client’s project, they can terminate the project effective immediately and the project will be billed at the price stated on the proposal/invoice.

  • All images are delivered in our client area of this website and/or other file sharing software.

    • You will have a gallery set up and be sent a link so you can access, preview and choose your images, then you will be sent a link to where you can download your images.

    Please keep in mind that when you order a photo package we spend a lot of time editing, and working our magic in between other shoots, filming and projects. Even though you may have already had your shoot, we still have some more to do before you can view our final results.

    • Please allow 2-4 weeks for your order to be completed after payment has been made in full and all steps of your project have been finished. Some of our services may require more than one meeting and/or shoot before the order can be finalized.

    Printed services/images can differ in delivery time. Please contact us with any specific questions. If you require a rush delivery please inquire as to how we can accommodate but an additional fee may be added.

    • When a payment has been made the order is considered final and that you as the client agree with our policies including but not limited to the ones written here.

    • By downloading images in a client gallery or receiving images electronically or physically we consider the order being delivered and finished.

    • By ordering or booking you agree that you have seen our portfolio and agree that it fits what you are looking for. We do cater to specific and custom projects but as we are a creativity based business can not always guarantee it will be exactly as visualized by the client, however we do our best to work together towards that goal.

    • For any projects where you have received a proposal or quote and the work is ongoing, either party has the right to give notice of termination to the proposal. Four weeks notice in writing must be given and any outstanding bills paid or services already paid for be fulfilled.

    • Middle Earth Media cannot guarantee any specific amount of sales or income driven to the client by any of our marketing projects, events, fundraisers or ads.

    • We cannot guarantee any specific amount of online engagement or followers with any social marketing package or project; but will provide reports and results on any ongoing projects related to the client.

    • Our goal is to always deliver to the set goals outlined in the projects/proposals.

    • Middle Earth Media will always work in good faith with the client and discuss any reservations or risks to the best of their knowledge and experience.

  • The economy, on a national and even worldwide scale, creates additional uncertainty and economic risk. An economic recession or depression might negatively affect the results produced by Middle Earth Media.

  • f the performance of any agreement between Middle Earth Media and the client, or any obligation hereunder is prevented, restricted, or interfered with by reason of fire, flood, earthquake, explosion, pandemic, or other casualty or accident, strikes or labor disputes, inability to procure or obtain delivery of services, images or power, war or other violence, any law, order, proclamation, regulation, ordinance, demand or requirement of any governmental agency, or any other act or condition whatsoever beyond the reasonable control of the affected party, the party so affected, upon giving prompt notice to the other party, shall be excused from such performance to the extent of such prevention, restriction, or interference; provided however, that the party so affected shall take all reasonable steps to avoid or remove such cause of nonperformance and shall promptly resume performance hereunder.
